Welcome to VitaForge. These Terms of Use ("Terms") govern your access to and use of the VitaForge website, landing pages, supporter pages, mobile application, content, programs, features, digital products, communications, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not access or use the Platform.
1. About VitaForge
VitaForge is a fitness and wellness platform designed to provide users with access to training-related content, educational materials, coaching-style guidance, digital tools, and related features intended for general fitness and wellness purposes only. The Platform is operated by or on behalf of VitaForge ("VitaForge," "we," "us," or "our").
2. Eligibility
You may use the Platform only if you are legally capable of entering into a binding agreement under applicable law. If you are under the age of 18, you may only use the Platform with the permission and supervision of a parent or legal guardian, to the extent permitted by applicable law.
3. Health and Medical Disclaimer
The Platform is provided for general fitness, wellness, and educational purposes only. VitaForge is not a medical provider, and nothing on the Platform constitutes or should be interpreted as medical advice, diagnosis, treatment, physiotherapy advice, nutritional therapy, or any other healthcare service.
- Participation in exercise, fitness, and wellness activities involves inherent risks.
- You are solely responsible for evaluating your own physical condition and suitability before participating in any workout, program, exercise, stretch, challenge, recommendation, or routine.
- You should consult a qualified physician or other licensed healthcare professional before beginning or modifying any exercise, nutrition, or wellness program, especially if you have any medical condition, injury, pain, limitation, or concern.
- You must immediately stop any activity and seek appropriate medical advice if you feel pain, dizziness, faintness, shortness of breath, chest discomfort, or any unusual symptom.
Your use of the Platform and participation in any activity described or suggested through the Platform is at your own risk.
4. No Guarantee of Results
Individual results vary significantly. VitaForge does not guarantee any particular fitness, health, appearance, performance, strength, weight-loss, or other outcome. Any testimonials, examples, or illustrative results shown on the Platform are not promises or guarantees of future results.
5. User Accounts
To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information and to keep such information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
6. Acceptable Use
- Use the Platform only for lawful, respectful, and intended purposes.
- Do not interfere with, disrupt, damage, or compromise the security, integrity, or performance of the Platform.
- Do not copy, scrape, reproduce, republish, distribute, modify, reverse engineer, decompile, disassemble, or create derivative works from any part of the Platform, except where expressly permitted by law.
- Do not use bots, scripts, crawlers, automation tools, or other technical means to access or extract data from the Platform without our prior written consent.
- Do not upload or transmit malware, malicious code, or harmful material.
7. Subscriptions, Paid Features, and Billing
Certain parts of the Platform may be offered on a paid basis, including subscriptions, digital products, premium access, early access, supporter benefits, or future paid services. If you purchase any paid feature, you agree to pay all applicable fees, charges, taxes, and amounts disclosed at the time of purchase, and you authorize VitaForge and its payment processors to charge your selected payment method.
Unless otherwise required by applicable law, all fees are non-refundable once paid, including partial subscription periods, unused access periods, change-of-mind purchases, and accidental non-use.
8. Founding Supporters, Sponsors, and Voluntary Contributions
VitaForge may offer opportunities for individuals or entities to support the project financially through voluntary contributions, supporter packages, founding supporter programs, sponsorships, backer programs, or similar initiatives.
Unless expressly agreed otherwise in a separate written contract signed by VitaForge, any payment made to support VitaForge shall be deemed a voluntary support payment or supporter purchase and:
- does not create any partnership, joint venture, agency, fiduciary relationship, franchise, employment relationship, or investment relationship;
- does not grant the payer any equity, shares, ownership interest, beneficial interest, profit participation, governance right, voting right, management right, approval right, or decision-making authority in VitaForge or any related business, brand, software, platform, product, domain, content, or intellectual property;
- does not grant the payer any right to claim reimbursement, repayment, return on investment, revenue share, royalty, commission, or future financial return;
- does not transfer any intellectual property rights, license rights, source code rights, brand rights, naming rights, or ownership rights of any kind.
9. Intellectual Property
The Platform and all content, materials, branding, visual elements, designs, interfaces, software, text, graphics, videos, audio, workout structures, program formats, methods, names, logos, trademarks, service marks, trade dress, layouts, and other materials made available through the Platform are owned by VitaForge and/or its licensors and are protected by applicable intellectual property laws.
Except for the limited right to use the Platform for its intended personal and lawful purposes, nothing in these Terms grants you any ownership or license rights in or to the Platform or its content.
10. User Content
If you submit reviews, comments, messages, testimonials, suggestions, ideas, images, feedback, or other content to VitaForge ("User Content"), you represent that you have the right to submit it and that it does not infringe any third-party rights. By submitting User Content, you grant VitaForge a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, adapt, publish, display, distribute, and otherwise use such User Content for operating, improving, promoting, and providing the Platform, subject to applicable law and our Privacy Policy.
11. Platform Availability and Changes
We may add, modify, suspend, remove, or discontinue any aspect of the Platform at any time, including features, content, pricing, availability, design, programs, integrations, or functionality. We do not guarantee that the Platform will always be available, uninterrupted, secure, error-free, or compatible with every device, browser, operating system, or region.
12. Third-Party Services and Links
The Platform may contain links to third-party websites, payment services, app stores, analytics services, social platforms, embedded tools, or other third-party resources. We are not responsible for the content, availability, security, terms, privacy practices, products, or services of third parties.
13. Disclaimers
To the fullest extent permitted by law, the Platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. VitaForge disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, and quiet enjoyment.
14. Limitation of Liability
To the fullest extent permitted by law, VitaForge and its founders, owners, affiliates, licensors, contractors, service providers, officers, directors, employees, and representatives shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, loss of revenue, loss of business opportunity, loss of data, loss of goodwill, personal injury, or business interruption, arising out of or related to your access to or use of, or inability to use, the Platform.
To the fullest extent permitted by law, VitaForge’s total aggregate liability for any claim arising out of or relating to the Platform or these Terms shall not exceed the greater of the amount you paid to VitaForge in the twelve (12) months preceding the event giving rise to the claim, or one hundred euros (€100).
15. Indemnification
You agree to defend, indemnify, and hold harmless VitaForge and its affiliates, founders, owners, licensors, service providers, officers, directors, employees, contractors, and representatives from and against any claims, actions, demands, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising out of or related to your use or misuse of the Platform, your breach of these Terms, your violation of any applicable law or third-party right, your User Content, or your participation in any training, workout, exercise, or fitness-related activity associated with the Platform.
16. Termination
We may suspend, restrict, or terminate your access to all or part of the Platform at any time, with or without notice, if we believe you have violated these Terms, created risk or potential legal exposure, or engaged in conduct harmful to VitaForge, users, or third parties.
17. Privacy
Your use of the Platform may also be governed by our Privacy Policy.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to conflict of law principles.
19. Jurisdiction
To the extent permitted by applicable law, the courts of the competent jurisdiction in Belgium shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Platform. If mandatory consumer protection law gives you the right to bring claims in another competent court, nothing in this clause limits those mandatory rights.
20. Changes to These Terms
We may update or modify these Terms from time to time. The updated version will become effective when posted on the Platform, unless otherwise stated. Your continued use of the Platform after updated Terms become effective constitutes your acceptance of the revised Terms.
